50B Protective Order Violation

A 50B protective order violation is a Class A1 misdemeanor punishable by up to 150 days of active jail time. To be guilty of this offense, a person has to knowingly violate a valid protective order pursuant to Chapter 50B of the North Carolina General Statutes, a court order of another state regarding domestic violence, or a court order of an Indian tribe with regards to domestic violence. A 50B protective order is basically a restraining order between two people in a domestic relationship. This includes spouses, children of spouses, members of the opposite sex who are in a dating relationship, members of the opposite sex living together or formerly lived together, and their children.
